These terms apply to the Shifts to Showings website pages, free guide, waitlist and community (together, the Services), operated by Shifts to Showings LLC. In these terms, we and us mean Shifts to Showings. By using the Services, you agree to these terms. If you do not agree, please do not use them.
Independent venture and no affiliation with Compass
Shifts to Showings is an independent business owned and operated solely by Shifts to Shownings LLC and Frank Schiavone in a personal capacity. It is not owned, operated, sponsored, endorsed, approved or supervised by Compass, Inc., Compass International Holdings, or any of their parents, subsidiaries, affiliates, franchisees, brands or related companies (together, Compass).
Compass has no involvement in, and no responsibility or liability for, the Services, the free guide, the community, any coaching, content, events or advice provided through them, or any statement made by Shifts to Showings, its members or its guests.
Nothing in the Services is an offer, statement, policy, training program or recruiting effort of Compass, and nothing in the Services should be relied on as such.
Joining Shifts to Showings does not create any relationship with Compass, including employment, independent contractor, agency or brokerage affiliation, and does not guarantee or suggest any opportunity to join Compass.
Any reference to Frank Schiavone's real estate license, sales history, rankings or experience describes his personal background only. It does not mean Compass reviewed or approved the Services.
Compass names, logos and trademarks belong to their owners and are not used in connection with the Services to suggest any endorsement.
To the fullest extent the law allows, you agree not to bring any claim against Compass arising from or related to the Services. Any claim related to the Services must be brought only against [Business name].
Not real estate, legal, tax or financial advice
The Services are for general education and community support. They are not real estate brokerage services, and they are not legal, tax, accounting, financial or licensing advice. Licensing rules differ by state. Check the requirements with your state's real estate commission and get advice from qualified professionals before making decisions.
No income guarantee
Any mention of income, earnings, sales volume or career results, including Frank Schiavone's own, is an example and not a promise. Results vary and depend on many factors, including your effort, market conditions, your brokerage and your location. We do not guarantee that you will get licensed, close a transaction or earn any amount of money.
Eligibility
You must be at least 18 years old to use the Services.
Your account and conduct
You agree to give accurate information, keep your login details private, and treat other members with respect. You may not harass anyone, share another member's private information, spam or solicit members without permission, post unlawful content, or copy and resell our materials. We may remove content or suspend or end access for anyone who breaks these terms.
Memberships, billing and cancellation
Paid memberships are processed through our checkout provider and are subject to its terms as well.
Our content
The free guide, videos, webinars, templates and other materials are owned by Shifts to Showings or its licensors. You may use them for your own personal learning. You may not copy, share publicly, sell or create products from them without our written permission.
Member content
You keep ownership of what you post in the community. By posting, you give us permission to display it within the Services. Do not post anything you do not have the right to share.
Third party services and links
The Services may link to or rely on other companies' websites and tools. We are not responsible for their content, policies or practices.
Disclaimers
The Services are provided as is and as available, without warranties of any kind, to the fullest extent the law allows.
Limitation of liability
To the fullest extent the law allows, Shifts to Showings and Frank Schiavone will not be liable for any indirect, incidental, special or consequential damages, or for lost profits, arising from your use of the Services. Our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim, or $100 if you paid nothing.
Indemnity
You agree to cover any claims, losses or costs, including reasonable attorney fees, that Shifts to Showings, Frank Schiavone or Compass incur because of your use of the Services, your content, or your breach of these terms.
Governing law
These terms are governed by the laws of the State of [State], without regard to its conflict of law rules. Any dispute will be handled in the state or federal courts located in [State].
Changes to these terms
We may update these terms. We will post the new version on this page with a new effective date. Continuing to use the Services means you accept the changes.
